Avril Lavigne Being Sued - Here's the Song Comparison

So Avril Lavigne is being sued by a 70's pop band for allegedly stealing their song.

Songwriters Tommy Dunbar and James Gangwer alleged in a lawsuit filed in U.S. District Court that Lavigne and her co-writers lifted their 1979 song "I Wanna Be Your Boyfriend," which was originally performed by the band The Rubinoos.

This video has become very popular lately and compares the two tracks side by side. There is also an argument forming in the YouTube community that the Rubinoos tune borrows heavily from the Rolling Stone's "Hey You, get off of my Cloud" but I think thats just because of the chorus and the "Hey (hey) YOU (you)" line sounding the same. Other than that, the Rubinoos and the Stones dont sound anything alike.

The Rubinoos toured and recorded from 1975 to 1983 and had a hit with a cover version of Tommy James and the Shondells' "I Think We're Alone Now." They also wrote the theme song for the movie "Revenge of the Nerds."

When comparing the two songs with the YouTube clip, it seems clear that this is a total rip-off of the Rubinoos's track.

"We are not so naive as to chalk it up to some sort of cosmic coincidence," Dunbar said Thursday. "The lyric, the meter, the rhythm -- they're identical."

Those songs don't sound the same to me. Even after concentrating really hard, I fail to see the resembelance. The first song is slow, moody, boring, and something a lonely, dreamy, teenage girl might like. The second song has a fast beat, with more energy, and sounds a heck of a lot better than the first. If Avril copied the older bands' song, then this video failed to prove it.
